Terms and Conditions for Snow Fall Service

1. Service Description

The Snow Fall service, operated by GLOV Solutions (R.C.S. Lyon 938 233 376), offers, among other things, hosting, management, and maintenance of non-custodial Masternodes / Smartnodes / Validator nodes. The end client is therefore the sole owner of their private keys, allowing access to their crypto-assets. The initial setup requires communication between Snow Fall experts and the end client to assist them in the implementation.

A dashboard allowing the client to view real-time information about their services is available.

The installation time varies depending on the selected project and is indicated at the time of selection.

Article 2: Definitions

The complexity of technical knowledge and the specific vocabulary related to cryptocurrencies varies from person to person, making it impossible to provide an exhaustive definition of every term used in these General Terms and Conditions of Sale (GTCS). However, we are willing to provide detailed explanations and definitions upon client request. Furthermore, we are open to adding these terms to existing definitions to prevent any future misunderstandings.

Each of the terms mentioned below has the following meaning in these General Terms and Conditions:

  • Wallet (Crypto Wallet): A crypto wallet is a device or software used to store, send, and receive cryptocurrencies. There are different types:
    • Hardware Wallet: Such as Ledger or Trezor, it is a physical device resembling a USB key, used to store cryptocurrencies offline, making it more secure.
    • Software Wallet: Such as Metamask, it is a program installed on a computer or smartphone to manage cryptocurrencies.
    • Web Wallet: Such as MyEtherWallet, it is an online platform to manage cryptocurrencies directly through a web browser.
  • Non-custodial (wallet): A non-custodial wallet is a type of wallet where you have complete control over your private keys (and thus your cryptocurrencies). You are fully responsible for the security and management of your keys.
  • Seed (phrase): The seed phrase, or recovery phrase, is a series of words generated by an electronic wallet. It is used to regain access to your cryptocurrencies in case of loss or damage to your wallet. It must be kept secure, as it grants access to your funds.
  • Masternodes, Nodes: Masternodes, or nodes, are servers within a blockchain with special responsibilities. To become a masternode, a certain amount of cryptocurrency must be staked. In exchange for their service, masternode owners receive rewards in cryptocurrencies.
  • Slashing: In the context of cryptocurrencies, slashing is a penalty imposed on validators or nodes for malicious or faulty actions, which may result in the loss of part of their stake.
Article 3: Installation and Commissioning

This includes all the technical aspects necessary for the provision of the service: installation, configuration, securing, and any other required actions on the servers, as well as the installation and configuration of the nodes.

This also includes assisting the client in activating their node via the configuration of their wallet.

Article 4: Dashboard

A future dashboard is being prepared to bring together all Snow Fall services. It will allow the client to track their orders, their status, and contact customer service and the technical team.

Article 5: Duration - Termination
  • Duration: The minimum commitment period is three (3) months from registration, with monthly payments. The contract will then be automatically renewed for new periods of three (3) months unless terminated by either Party, notified by email at least thirty (30) days before the end of the term.
  • Termination: In case of non-fulfillment by either Party of its obligations under the contract, the other Party may terminate it fifteen (15) working days after a formal notice has been sent by registered letter with acknowledgment of receipt to the defaulting Party, which remains without effect, or immediately in case of serious non-fulfillment not subject to remedy.

In the event of payment failure, the service provided will be suspended 48 hours after a first reminder without response.

Termination of the contract will not give rise to any compensation.

Article 6: Availability of Services

The client’s access to the services is provided through a dedicated online interface. Services are available 24/7, except in cases of force majeure and subject to any breakdowns and maintenance interventions necessary for the proper functioning of the services.

In the event of malfunction or anomaly hindering the proper functioning of the services, Snow Fall undertakes to carry out the necessary repairs as soon as possible.

Any temporary suspension of services for maintenance or updates will be notified to the client whenever possible.

Article 7: Penalties for Breach

In the event of a breach by a client of any of the provisions of these General Terms and Conditions or more generally in the event of a violation of the laws and regulations in force, Snow Fall reserves the right to take any appropriate action, including suspending or terminating the client’s access to the services, notifying the competent authorities, and taking legal action against the offending client.

Article 8: Client Complaints

Any dispute or request from a client relating to a malfunction of the services must be notified to Snow Fall within seven (7) calendar days from the day the client becomes aware of it. This notification must be made in writing to the following email address: contact@snow-fall.io.

The complaint must specify the errors or faults observed in connection with the use of the services. Snow Fall undertakes to process the complaint and provide a response as soon as possible.

Article 9: Personal Data

To enable the use of services by clients, Snow Fall processes personal data in accordance with the General Data Protection Regulation (GDPR). The personal data collected is necessary for the provision of the services and is processed in compliance with applicable laws.

The client has the following rights regarding their personal data:

  • Right of access and rectification: The client may request access to their personal data and rectify it if it is inaccurate.
  • Right to erasure: The client may request the deletion of their personal data, subject to Snow Fall’s legal obligations.
  • Right to restriction of processing: The client may request the restriction of the processing of their personal data in certain cases.
  • Right to object: The client may object to the processing of their personal data for legitimate reasons.

Personal data is retained for the duration necessary to provide the services and in accordance with Snow Fall’s legal obligations.
